APEC University

 

The Phoenix Legal institute of Arbitration (Phoenix Legal) offers ADR education and professional development programs and seminars for advocates, arbitrators, mediators and legal counsellors conducted online, and on-campus internationally and regionally.

Advocate      v.  To speak or write in favour of; support or urge by argument; recommend publicly:
                        n. A person who speaks or writes in support or defense of a person, cause, etc. (usually fol. by of). A person who pleads for or in behalf of another; intercessor. A person who pleads the cause of another in a court of law.

Arbitrator      n.   A person chosen to settle the issue between parties engaged in a dispute. See Synonym ' judge'. One having the ability or power to make authoritative decisions; an arbiter.

Mediator        n.  One that mediates, especially one that reconciles differences between disputants.

Counsellor   n. A person who gives counsel a legal adviser

Chairman      n. The officer who presides at an ADR hearing; "address your remarks to the chairperson" [syn: president] 

                        v. Act or preside as chair, as of an ADR hearing; "She chaired ADR hearings for many years" 

 

ONLINE TRAINING

Phoenix Legal offers the convenience of Online ADR training and education programs that are all self-managed and self-paced for convenience and efficiency. On-line training is conducted through open-enrolment programs that employ the Oxford tutorial model with the student working with his/her supervisor on a one-to-one basis that is supportive for gaining beneficial development, knowledge, expertise and skill in the specific ADR area(s) of interest. The course carries an internationally accredited certificate.

PERSONAL TRAINING

Phoenix Legal personal trainers offer support and skill development to professionals in all aspects of ADR. A personal trainer works with the professional in the privacy of their office, business and/or home using customised course curricula and employ experiential knowledge that can directly relate to the case in point. Personal training courses can be conducted online, on-campus or off-campus.

Successful Mediation Support (SMS007)

At the successful conclusion of this course an arbitrator/mediator will be able to understand the process and procedures to mediate, facilitate and achieve a successful resolution to a dispute. The course provides a generally complete introduction and overview to the mediation facilitation process and includes instruction manual and best practice in party representation knowledgeably and successfully. The course is made up of 12-parts taking some 12-hours. The Course is non-examinable and a Certificate of Completion is available after completing the course. Registration Fee: $295.00

Chairing the Arbitration Panel: methodology, procedure and dynamism (IFMPD001)

At the successful conclusion of this course the arbitration Chairman (latin. manus ~ 'hand') will be able to chair a 3-person Arbitration Panel, while confidently employing professional methods and standards that are seen to support all panel members and parties to reach a timely, methodical and just dispute resolution. The course is designed to facilitate the development of confidence through an understanding of arbitration methods and procedures for the new/emerging Chairman to lead and maintain a focused, dynamic arbitration environment that is supportive of parties through Best Practice methods and procedures that are prompt, cost-effective, and transparent. Registration Fee: $175.00.

 

Transacting Tactical Delays in Arbitration (IFTTDA002)

At the successful conclusion of this course the commerce, building, construction and employment arbitrator will be able to identify and successfully transact different types of delaying tactics and be able to predict and identify their likely use, and hence strategise appropriate counter transactions to keep the process timely, and on track. The course focuses on arbitration methodology, procedure and dynamism to include, as opposed to trying to avoid, frustrating tactics that are likely to be used to delay, or even scuttle the process. The course program is designed to augment the Arbitrator's skill to manage outcomes over delaying-tactics so as to intentionally keep the arbitration case proceeding in a just and quick manner. Registration Fee: $195.00

Ethical Behaviour and Disclosure Requirements (IFEBDRIF003)

At the successful conclusion of this course the arbitrator will: -

  • Have a superior awareness of his/her ethical obligations that are applicable to transparently facilitating the arbitration case.
  • Be able to communicate and pass on the values of his/her disclosure responsibilities.
  • Be able to give to give advice on how to fully comply with his/her professional duty of disclosure in respect of all relationships and/or interests in any arbitration case.

Course subjects include: -

  • The Arbitrator and Ethics.
  • The Arbitrator's Duty of Disclosure.
  • Circumstances of Disclosure. When to disclose. Points.

Duties in Maters involved in the Self-Represented Client (IFDMISR004)

At the successful conclusion of this course the commerce, building, construction and employment arbitrator will be able to efficiently and effectively facilitate cases in which there is one self representing party that does not have an attorney present. The course is designed to support the arbitrator by providing successful management techniques and strategies to manage self-representation case outcomes in a professional and timely method. Registration Fee: $199.00

Awards: Decisions and Written Awards (IFADWA005)

At the successful conclusion of this course the arbitrator will be able to hand down award findings that are complete, understandable, and obligatory. The course consists of 8-parts. The award: -

  • Protection.
  • Facilitation.
  • Process for the conduct of the preliminary hearing,
  • Process for the conduct of closing the evidentiary hearing,
  • Decision.
  • Writing.
  • Issuing.
  • Post issues.

  Labour Arbitration (FLA006)

At the successful conclusion of this course the commerce, building, construction, employment and labour arbitrator will be able to systematically understand and administers labour arbitrations, and understand how to successfully work within the administrative framework.
